Introduction to Employees Liability

                                                                                                  
All employees earning salary wages of RM 2,000 or less a month are required to be insured under the Malaysian Social Security Act 1969. Such employee in the event of an accident arising in the course of employment can only claim benefits provided under the SOCSO Act. They are debarred from suing the employer under Common Law. The employees however can sue their fellow employees for negligence under the Common Law.

Employee earning above RM 2,000 per month are not required to be covered by SOCSO (unless they have been covered by SOCSO when they were earning less than RM2, 000). Such employees in the event of an accident arising in the course of employment can sue their employer for negligence under the Common Law.


Scope of Cover
i) To indemnify an Insured (Employer) when held to pay damage
ii) To pay for legal defense costs incurred when defending claim


Limit of Indemnity
The sum insured in Employer's Liability Policy is represented by the Indemnity Amount which is categorized into:-
i) Limit of Indemnity Any One Accident
ii) Limit of Indemnity Any One Period
The indemnity granted for any one accident is a fixed amount determined by the insured according to the exposure and  circumstances of the business.


Rating
i) Premium rate is computed on the estimated annual salary of each employee
ii) See Rating Table attached to Workmen's Compensation Insurance
iii) Minimum Rate: 0.10%
iv) Agents are advised to refer to the company for guidance where lower rates are expected to secure risks.

Special Note
The Employer's Liability Policy does not cover the foreign workers
The Foreign Workers means manual workers under this nationality e.g. Indonesian, Bangladeshi, Indian etc.

Minimum Premium
RM100.00

Referred / Declined Risks
Same as those listed in Workmen's Compensation Insurance.


Pengenalan keatas Liability Perkerja

Semua pekerja bergaji gaji bulanan sebanyak RM 2,000 atau kurang  dikehendaki hendak diinsuranskan di bawah Akta Keselamatan Sosial Malaysia 1969. Pekerja seperti dalam peristiwa kemalangan yang timbul dalam urusan pekerjaan hanya boleh membuat tuntutan faedah yang disediakan di bawah Akta PERKESO. Mereka dihalang daripada menyaman majikan di bawah Common Law. Pekerja bagaimanapun boleh menyaman rakan sekerja mereka kerana kecuaian di bawah Common Law.

Pekerja berpendapatan melebihi RM 2,000 sebulan tidak dikehendaki dilindungi oleh PERKESO (melainkan jika mereka telah dilindungi oleh PERKESO apabila mereka berpendapatan kurang daripada RM2,000). Pekerja seperti dalam peristiwa kemalangan yang timbul dalam urusan pekerjaan boleh menyaman majikan mereka untuk kecuaian di bawah Common Law.


Skop Perlindungan
i) Untuk menanggung rugi yang Diinsuranskan (Majikan) apabila diadakan untuk membayar kerosakan
ii) Untuk membayar kos pembelaan undang-undang tertanggung apabila mempertahankan tuntutan


Had Indemniti
Jumlah diinsuranskan dalam Polisi Liabiliti Majikan diwakili oleh Amaun Indemniti yang dikategorikan kepada: -
i) Had Indemniti mana Satu Kemalangan
ii) Had Indemniti Sebarang Tempoh Satu
Indemniti yang diberikan bagi mana-mana satu kemalangan adalah satu jumlah tetap yang ditentukan oleh yang diinsuranskan mengikut pendedahan dan keadaan perniagaan.


Penilaian
i) kadar premium dikira atas anggaran gaji tahunan setiap pekerja
ii) Lihat Jadual Penilaian dilampirkan kepada Insurans Pampasan Pekerja
iii) Kadar Minimum: 0.10%
iv) Agen adalah dinasihatkan untuk merujuk kepada syarikat itu bagi petunjuk di mana kadar yang lebih rendah dijangka untuk menjamin risiko.

Nota Khas
Polisi Liabiliti Majikan tidak meliputi pekerja asing
Pekerja Asing bermakna pekerja manual bawah contohnya kewarganegaraan ini Indonesia, Bangladesh, India dan lain-lain

RM100.00

Risiko Dirujuk / Ditolak
Sama seperti yang disenaraikan dalam Insurans Pampasan Pekerja (W/mens Comp).

被保险人根据马来西亚社会保障法“1969年,所有员工赚取RM2,000元或以下一个月的工资薪金的要求。该雇员在就业过程中因工遭遇意外的情况下,只能要求提供的福利下的社会保障组织法“。他们是禁止雇主根据普通法起诉。但是,员工可以起诉他们的同事们根据普通法的疏忽。

不要求员工每月收入超过RM 2,000所涵盖的SOCSO(除非它们已被覆盖的社会保险机构时,他们的收入低于RM2,000)。根据普通法,这样的员工在就业过程中因工遭遇意外的情况下,可以起诉他们的雇主疏忽。


覆盖范围
I)赔偿被保险人(雇主)举行,以支付损害时,
ii)为支付法律辩护费用在防守时要求


赔偿限额
雇主责任保险的保险金额的赔偿金额分为: - 
I)赔偿限额每次事故
II)赔偿限额任何一个时期授予任何一事故的赔偿是一个固定的数额,由被保险人根据曝光情况下的业务。

等级
I)溢价率是计算每个员工的年薪估计
II)评等表连接到工伤保险
III) 最低价格:0.10%
IV) 代理是指公司为指导,较低的利率,以确保风险。

特别提示
雇主责任保险不包括外劳
外劳是指根据本国籍,例如体力劳动者印尼,孟加拉,印度等。
